Is It Possible to Stop a Wage Garnishment?

If you neglect to pay off your debts, the people you owe could take you to court and acquire a Garnishment Order. How much will be garnished from your wages in that case? - It is up to the court to decide. Exceptions include Credit Unions that you have given an assignment of wage, and Canada Customs and Revenue Agency. Some refer to wage garnishment as having wages “garnished”, but the correct term is a garnishee or garnishment. The question is, how do you stop a wage garnishment?

Even if you agree to pay the debt, your creditor is not likely to lift the garnishment. After all, they’ve already gone through a good deal of effort to garnish your wages in the first place. Also, creditors garnish the people they believe will not pay, or the ones who have not paid in the past.

Three ways to stop wage garnishment include: repaying the debt, filing a proposal to the creditors, and filing for personal bankruptcy.

If you are currently being threatened with a garnishment, or are looking for a way to stop a wage garnishment that has already started, contact our bankruptcy trustee immediately so we can discuss your options. By postponing the problems you will only lose more money from your paycheques.
